This is the BPCL's advocate opinion after the Supreme Court judgement of 4.11.22 . Dear all

Arising out of various discussion in the industry and as well as with advocates, sr.advocates , following views are emerging and they are as under:

1.when a plain reading was given of the judgement, it was informed in the group that prior to 01/9/2014 are not eligible to get the enhanced pension 

2. After persuing the paragraphs 44(4), 44(5) and 44(6) , the legal luminaries are of the opinion that this judgement is equally applicable to pre 09/2014 and after 09/2014.

3. When R.C.GUPTA ' S verdict is upheld, all aspects are covered.

4.yesterday also sr. Advocate Mr. Anandapadbhanabhan, has also retriated the same view.

5. Let's not rush to supreme court at this stage for any clarification / review.

6.after the release of EPFO the fresh circular we will decide.

7. As of now all the retirees are eligible for the enhanced pension.
