Update on 29 January"s proceedings in SC for EPS-95 Enhanced Pension
HALE President has witnessed today's proceedings at SC via teleconferencing.
The Counsel of EPFO spoke vehemently that
- 1. RC Gupta case was entirely for those who were contributory to EPFO.
- 2. Exempted trusts maintain their own account, only EPS funds come to EPFO.
- 3. There will be imbalance of funds as EPFO disburses from the interest accrued from the funds deposited.
- 4. By allowing with retrospective effect, no. of pensioners will increase multifold.
- 5. Pawan Hans employees case was referred - and Counsel pleaded not to allow.
- 6. The dismissed SLP to be reviewed.
Counsel for some petitioners requested for linking all related WP's which were not listed today.
The judgement was in favour of EPFO, in a way, as the SC allowed the Review Petition stating that there are issues involved which require a 'closer look' and fixed up the next date in Feb.
The SC asked Registery to list all the interlinked cases together and allowed all the respondants to file their replies/affidavits.
