EPS 95 HIGHER PENSION NEWS: Kerala High Court Landmark Decision Give Higher Pension to EPS 95 Pensioner Within Six Month, Order on 6 November

EPS 95 HIGHER PENSION CASE STATUS | EPS 95 HIGHER PENSION SC ORDER 


The Kerala High Court has directed to pay PF pension in accordance with salary within six months as per the previous order. The division bench including Justices A. M. Shefeeq and P Gopinath directed to implement the Kerala High Court order issued on October 12, 2018. The new order was issued after settling around 80 contempt of court cases questioning the non-implementation of the previous Kerala High Court verdict.

The Kerala High Court also clarified that the verdict will be subject to the judgments of the petition filed by the EPF and the Union Ministry of Labour in the Supreme Court. The present directive will be applicable to around 400 people who had joined as a party in the contempt of court case. Employees from Kerala Forest Development Corporation, HOC, HNL, and others have approached the court.


The Employees' Provident Fund Organisation (EPFO) was not ready to implement the court order issued in 2018. After the contempt of court case was filed, many people started receiving a pension in accordance with their salaries.

Following this, the EPFO filed a petition in the Supreme Court, which was rejected. Following this, the EPFO filed a review petition. Meanwhile, the Union Ministry of Labour also approached the SC. The EPFO then issued a circular stating that a higher pension need not be provided as the matter was under the consideration of the apex court.



Following this, the employees moved the contempt of court petition in HC. Before implementing the EPF pension, an employee used to receive Rs 1,500 to Rs 3,000 as a pension. If the pension is raised in accordance with the salary, this amount would increase considerably. However, the EPFO argued that it did not have the funds to provide such a large amount of pension.
