STATUS REPORT REGARDING EPS 95 PENSION REVISION CASES AS PLACED BEFORE THE CENTRAL BOARD OF TRUSTEES (CBT), EPF IN ITS 227TH MEETING HELD ON 09.09.2020 - VERY IMPORTANT FOR PRE-1.9.2014 RETIREES FROM UN-EXEMPTED ESTABLISHMENTS

EPS 95 HIGHER PENSION NEWS | EPS 95 PENSION HIKE | EPFO CBT MEETING 

Before starting in 13.08.2020, article a very important post containing the prayers in the Review Petition filed by EPFO and SLP filed by UOI which are pending in the Supreme Court of India (Computer generated – Likely to be listed on 16.10.2020) for the information of my pensioner friends. Further, EPFO as well as UOI had also prayed for STAY on the operation of judgment dt. 12.10.2018 of Kerala High Court BUT NO STAY HAS BEEN GRANTED TILL DATE – meaning thereby; with the dismissal of SLP of EPFO on 01.04.2019, the judgment dt. 12.10.2018 of Kerala High Court has been confirmed/upheld. In the WPs decided by the judgment of Kerala High Court dt. 12.10.2018, the petitioners were Post 01.09.2014 retirees from Exempted as well as Un-exempted Estts. As on date, the GSR 609(E) dated 22.08.2014 (affecting Post-01.09.2014 retirees) stands set-aside & the order is valid across the country.

All EPS 95 Pensioners have observed that EPFO is misguiding/confusing the various High Courts while opposing the petitions filed even for the Pre-01.09.2014 retirees of Exempted as well as Un-exempted establishments stating that an SLP filed by Union of India and a Review Petition filed by EPFO are pending in the Hon’ble Supreme Court of India. Petitioners in various writ petitions are requested to please bring the above facts to the notice of their advocates so that EPFO Counsels may not succeed in confusing the Hon’ble Courts anymore on the pretext of pending SLP & Review Petition which are NOT RELEVANT FOR UN-EXEMPTED ESTABLISHMENTS who retired prior to 01.09.2014.
