NAC के राष्ट्रीय अध्यक्ष कमांडर अशोक राऊत जी का NAC मुख्यालय टीम सहित दिल्ली दौरा

दिनांक 07.02.2023 को NAC के राष्ट्रीय अध्यक्ष कमांडर अशोक राऊत जी का NAC मुख्यालय टीम सहित माननीय केंद्रीय कानून राज्य मंत्री श्री एस पी सिंह बघेल जी से भेट की।

इस बैठक में माननीय सुप्रीम कोर्ट के आर सी गुप्ता और अन्य मामलों पर  फैसले की गलत व्याख्या और स्तविक वेतन पर पेंशन के लाभ से पेंशनर्स वंचित- न्याय हेतु माननीय मंत्री महोदय को सौंपा गया ज्ञापन।

माननीय मंत्री महोदय के समक्ष NAC के राष्ट्रीय अध्यक्ष ने EPS 95 पेंशनर्स की ओर से निवेदन किया कि वास्तविक वेतन पर पेंशन के लाभ के मामले पर सुप्रीम कोर्ट के दिनांक 04.10.2016 और 04.11.2022 के फैसले पर  EPFO ने दिनांक 29.12.2022 को एक पत्र जारी किया, जो माननीय सुप्रीम कोर्ट के निर्णय में निहित निर्देशों विशेष रूप से अनुच्छेद 44(iv) और 44(ix) के विपरीत हैं और पेंशनर्स को वास्तविक वेतन पर पेंशन के लाभ से वंचित करता है. आगे NAC चीफ ने मंत्री महोदय से निवेदन किया कि माननीय मंत्री महोदय स्वयं इस विषय में हस्तक्षेप करें जिससे कि फैसले की सही व्याख्या करते हुए पेंशनर्स को न्याय से वंचित न रखा जाए।

अपना पक्ष रखने के बाद NAC चीफ द्वारा केंद्रीय कानून मंत्री/कानून राज्य मंत्री को इस संदर्भ में विस्तारपूर्वक लिखा पत्र सौंपा गया।

माननीय मंत्री महोदय जी ने पत्र को ध्यानपूर्वक पढ़ा और पत्र पढ़ने के बाद कहा कि इस फैसले की जानकारी मुझे हैं। आपने जो पत्र में लिखा है उसे हम कल ही श्रममंत्री जी को उचित कारवाई हेतु भेज देंगे।

On dt. 07.02.2023 National President of NAC Commander Ashok Raut along with NAC had Meeting with Hon'ble Union Minister of State for Law Shri SP Singh Baghel Ji.

Misinterpretation of judgment of Hon'ble Supreme Court in RC Gupta and other cases and deprivation of pensioners from benefit of pension on actual salary- 

Memorandum handed over to Hon'ble Minister for Justice.

On behalf of EPS 95 pensioners, the National President of NAC submitted to the Hon'ble Minister that on the Supreme Court's decision dated 04.10.2016 and 04.11.2022 regarding the benefit of pension on actual salary, the EPFO ​​on 29.12.2022  issued a letter, which is contrary to the directives contained  in the judgment of the Hon'ble Supreme Court, specifically Paragraph 44(iv) and 44(ix) and deprived  the pensioners of the benefit of pension on actual salary.  It is submitted that the Hon'ble Minister himself should intervene in this matter so that the pensioners are not deprived of justice while interpreting the judgment.

After his submission a detailed written letter in this regard  by the NAC Chief to the Hon. Minister of State for Law....,

The Hon'ble Minister read the letter carefully and after reading the letter said that I am aware of this Judgement.We will send the letter you wrote, to the Labor Minister tomorrow for appropriate action.
