PF PENSION REVIEW PETITION WILL THE WAITING BE LONGER?
It's feared that implementation of higher pension as per SC order in favor of PF members, maybe delayed.
Since the matter is now before the SC, implementation of the November 4 SC order may be delayed, which is now feared by the employees and pensioners.
EPFO has not started actions towards implementation of the November 4 SC order giving higher pension proportionate to actual salary.
The review petition is not against implementation of the SC order but for giving the benefit to those who retired before September 2014 without exercising option, as clarified by the advocate on behalf of Retired Officers Welfare society, who has filed the review petition.
Retired officers of BPCL have also filed petition. Usually, review petition is examined by the judges who passed the orders, in their chamber.
No argument is held in open court. Chief Justice UU Lalit has retired and in his place another senior judge will be substituted.
Minimum one month may be taken for consideration of the review petition.
After issue of final orders, the document related to the case are transferred to the record room.
If the review petition is considered, then the documents have to be retrieved from the record room which is cumbersome.
From December 17 to January 1, SC is closed.
Review petition is considered only when there is clear error in the documents on whose basis the order was passed.
Here, the review petitioner has requested for open court hearing.
If this is accepted then notice will have to be served on opposite sides including EPFO, labour ministry etc and in that event, sufficient time will have to be given for filing replies, etc..
The government may also seek further time for giving replies and so the matter may be dragged on further. THAT'S WHY FRIENDS, YESTERDAY I SAID THAT WE ARE IN FOR A LONG WAIT.
