EPS 95 पेंशनधारकों उच्च पेंशन बढोतरी: Kindly through the light and clarify and guide for getting the higher pension

1. What does it mean that SC judgment will not be applicable to those members who were not member of EPF/EPS and did not exercise their option befire 01.09.2014 whereas RC Gupta's case has abolished the condition of 'Cut Off' date to exercise of option and SC has accepted or allowed this judgment extending the date of submission of option u/clause 11(4) of EPS for higher pension. ?

2. How the option can be submitted until and unless the EPFO or Employer ask for submission of option to the employee(s)?

3.If the employer doesn't agree for exercising the 'Joint Option', what will be further course of action to agree employer ?

4. What amount of pension will be paid for an employee who has contributed 8.33+8.33%( employee & employer share) but EPFO has calculated on the minimum amount of Rs. 5000/- or 6500/- instead of 50% of the salary drawn on superannuation?

5. I have been retired on 28.02.2015 after superannuation and EPFO has been paid 8.33+8.33% till superannuation & getting Rs.2148/- as pension. I have not been asked for any kind of option by employer or EPFO till today whereas contribution has been deducted on enhanced salary above over minimum fixed wages. What I have to do as per judgment? 

6.Whether the employee retired in 2012 and the joint option for higher pension was rejected by EPFO can once again submit the joint option if so, what is the procedure?

7.For what purpose Extension of 4 and 4 months has been granted? 

8. The amt 1.16% is required to be paid by Govt as per EPF Act. Then who will bear for higher pension?

9. If total amount @8.33 share of employer on enhanced salary has been paid for payment of higher pension, this amount should be shifted to Pension Fund and 50% of the last pay drawn on superannuation can be paid ?

10. What actions are required to be taken by a retired employee for getting higher pension. Please guide me.
