EPS 95 Higher Pension Cases Supreme Court Final Judgment 4 November 2022: Historical Judgement in the case of amended EPS 95 Pension case has been pronounced

Date 4.11.2022:  Dear EPS 95 Pensioner friends Heartiest congratulations. Today much awaited Historical Judgement in the case of amended  EPS 95 Pension case has been pronounced in favour of lakhs of pensioners with the blessings of Almighty God.Prayers of lakhs of pensioner and prospective pensioners have been answered by Almighty Wahe Guru ji and before the Gurpurab"Prakashtosav" the most needed precious gift has been given to us by Guru Sahiban.Complete details of judgement will be available after the uploading of Judgement.


This Judgement was pronounced by two judge Bench of Hon'ble Justice Anuriddha Bose and Hon'ble Justice Vikram Nath.Heartiest thanks to the three Judge Bench headed by Hon' ble Chief  Justice of India Justice UU Lalit, Hon'ble Justice Aniruddha Bose, Hon'ble Justice Sudhanshu Dhulia for providing justice to poor pensioners.

This is really a happiest and fortunate day for lakhs of Pensioners in General and in particular for me also as the upholding the quashing of GSR 609 will pave the way for newly recruitee after 1.9.2014 to join this EPS 95 pension scheme.

2014 amendment upheld with suitable reading down (judgment needs to be seen)


2. Law laid down in RC gupta has been upheld

3. For employees in service and were not allowed to exercise option pre 2014 under proviso to 11(3)— they shall be entitled to exercise said option under amended 11(4)

4. For employees that have retired — it appears that if they retired prior to 2014– they can exercise the option— but the judgment needs to be studied for further clarity
