EPS 95 Higher Pension News: Very Important Suggesion to PM Modi For Payment of Higher Pension to EPS 95 Pensioners Based on Kerala High Court Order.

Respected Shri Narendra Modi ji,

I would like to invite your kind attention to the pendency or special leave petition C No. 8658 and 8659 of 2019 and connected cases before The Honorable Supreme Court of India. Batch of cases pending before The Honorable Supreme Court of India relating to the issue of payment of pension under employee pension scheme 1995.


This issue in the batch of cases is affecting the right of senior citizen across the country who are beneficiaries of the Employee Pension Scheme 1995. Citing the pendency of proceeding before The Honorable Supreme Court of India, Employee Provident Fund Organisation has now stop payment of legally entitled monthly pension to the beneficiaries of the employee pension scheme 1995. It is pertienent to point out here that in special leave petition (C) No. 8658 – 8659 of 2019 The impugnent judgement dated 12th October 2018 of the Honorable Court High Court of Kerala is not stayed by the Honorable Supreme Court of India.


I have moved a private member resolution in this regard and the Honorable minister for labour had assured the Parliament that step will be taken for implementing judgement. But quite in variance to the Assurance given on the floor of Parliament the Employee Provident Fund Organisation and government of India is challenging the judgement. The central government and EPFO deliberately ignore the fact that the litigants and beneficiaries to the proceeding in the above referred order are all senior citizens.


The Employee Provident Fund Organisation and the central government are conducting the cases in this regard without  consideration the pathetic situation of senior citizen those who are entitled for the benefit. The steps taken by the EPFO and the central government  are adversely affecting the legal right of pensioner. The Employee Provident Fund Organisation and Central Government intentionally and deliberately protecting the procedure with the malafide intention of defeating the lawful right of the beneficiaries of the employee pension scheme 1995.


Therefore it is requested that Government of India may take initiative in despite the matter pending before The Honorable Supreme Court in which government of India is the petitioner and give necessary direction for payment of pension on the fact that the order of Lower court is not a stayed by the Honorable Supreme Court..
