Detailed information about the hearing of EPS 95 Pensioners AOR Shri Purushottam Sharma Tripathi ji on 18th August.
The EPF matters were listed before the Supreme Court for final hearing on August 18.
On August 17, EPFO was represented by Senior Advocate Shri C. A. Sundaram as well as the submission.
Shri Gopal Sankaranarayanan Senior Advocate was present through the proceedings of the Court and noted the arguments made by EPFO. At the same time, he also assisted the court during the afternoon hours and apprised the court about some of the provisions. In the evening he directed some points raised by EPFO to refute the arguments of EPS 95 pensioners.
On August 18, EPFO was headed by Senior Advocate Shri C. A. Sundaram and began its final arguments.
The EPFO has sought an indirect review of RC Gupta's decision, saying it cannot be made a binding precedent for pensioners. For this, the court said that the matter can be referred to a three-judge bench.
He referred to the High Court's single judge judgment which directed that RC Gupta's decision should not be treated as a binding precedent on others. He has further wrongly stated that the provident fund scheme and pension fund scheme are clearly managed.
Mr. Gopal Sankaranarayanan Senior Advocate has specifically rebutted the arguments of EPFO and brought before the Court the fact that the investment portfolio of the Provident Fund Scheme under Article 52 of the PF Scheme 1952 and the Pension Scheme under Para 26 of the Pension Scheme have It is essential that the money is invested equally.
He further argued that the RC Gupta case is substantiated by the provisions of the EPF Act 1952, EPF Scheme 1952 and Pension Scheme 1995.
So there is no need to refer the matter to a larger Bench. The Supreme Court has agreed to hear the side of EPS 95 pensioners next week before deciding on the need for the reference of a larger bench.
Now on 24th August, again the side of EPS 95 pensioners will be put on these matters and decision will be given on these high pension cases.
