Sub: Allowing members of the Employees' pension scheme 1995 the benefit of the actual salary in the pension Fund exceeding wage limit of either Rs.5000l- or Rs. 6500l- per month from the effective date respectively as per the Hon'ble supreme court's order in the matter of R.C. Gupta & others v/s RPFC, Shimla in SLP No. 33032-33033 of 2015
EXTRACTS:
• The department had filed more than I0 SLPs before the Hon’ble Supreme Court against the orders passed by Hon'ble High courts. The same have been dismissed by Hon'ble Supreme Court stating that "we do not find any legal and valid ground for interference; the special leave petitions are dismissed.
• It was agreed that compliance may be made immediately in respect of the Provident Fund & Pension Members including superannuated.
• Regarding the financial liability involved in implementing the proposal, EPFO has stated that the financial liability in implementing the Hon’ble Supreme Court order will be met from the Pension Fund.
• EPFO had informed that the there is no financial liability on the part of GOI in this matter as GOl's contribution of 1.16 per cent of wages under EPS 1995 is restricted to the wage ceiling.
