EPS 95 Pensioners: Brief About EPS 95 Pensioners Higher Pension Case Status in Supreme Court, Very IMP Every EPS 95 Pensioner Must Know

Respected EPS 95 Pensioners, Brief About EPS 95 Pensioners Case Status:


All the WPs (writ petions) 45+ pending on EPS95 for higher pension on actual salary including contempt petition with SLP (Special Leave Petition) and RP (Review Petition) are tagged together by Supreme Court.

KHC (Kerala High Court) gave a verdit in Dec 2018 striking down the notifications issued by EPFO dt. Aug 28, 2014 and May 31, 2017 declaring them that they are unconstitutional. EPFO/UGI filed an SLP challenging the decision of KHC which was disallowed by SC on APR 04, 2019.  EPFO/UGI had filed a Review Petition (RP) also.


Earlier 10 SLP were dismised by SC it ous major strength. Former CJI Sri Rajan Gogoi dismissied one SLP on GSR 609 and allowed RP on it in open court.

The contention in RP are: 

  1. (i) Pension Fund will become unviable if higher pension considered.  
  2. (ii) EPFO/UGI also calculated the average as 83 years. 
  3. (iii) Where as UN the average age is only 70yrs. 
  4. (iv) Actuarial deficit shown as Rs.15,28,519.47 Cr. required 
  5. (v) Without Govt. support it is not possible to  EPFO. 


Our Union Govt. budget itself is 34 Lakh Crores. On Jan 29, 2021 - SC recalled the SLP filed by EPFO/UGI (Union Govt. of Inida) as a Speaking order was given earlier on it. Nothing more than this. 

Quashing of GSR 609 was prayed only in our & NCR/NCOA petions out of 45+ petitions.

  • Preliminary hearing got posted for Feb 25, 2021.  We may not get a chance of oral submission.
  • EPS 95 Pensioner have to submit a "short synopsis" to our respective AORs before Feb 23rd 2021 to get an opportunity for dismiss of SLP on that day.  In short send your points. 

  • Short synopsis cover should cover points like : GSR609, Pre & Post 01.09.2014 (option), Exempted &  unexempted establishments (Pawan Hans, Actuary report and Financial burden.
  • This shows how clearverly EPFO/UGI misleading not only themselves but SC and Pensioners.
