In today article i am sharing a information obtain with the help of RTI filed by Mr. Parveen kohali from MoL&E. This information is shared for EPS 95 Pensioners ready use

Please go through the attached reply of MoL&E dated 22.7.2020 wherein it has been clarified that except the approval dated 16.3.2017 granted by MoL&E no other approval has been issued by MoL&E.
Ministry of Labour & Employment, GOI thoroughly examined the proposal of EPFO and accorded approval dt. 16.3.2017 - Contents of which are being re-produced hereunder:

I am directed to refer to EPFO’s UO no. Pension-I/12/33/EPS Amendment/96/II/1839 dated 10.01.2017 on the above mentioned subject and to convey approval of the competent authority to allow EPFO to issue administrative instructions to allow members of the Employees Pension Scheme 1995 who had contributed on higher wages exceeding the statutory wage ceiling of Rs. 6500 in the Provident Fund to divert 8.33% of the salary exceeding Rs. 6500 to the Pension Fund with up-to-date interest as declared under EPF Scheme, 1952 from time to time to get the benefit of pension on higher salary on receipt of joint option of the Employer and Employee.

[Please note that neither there was any mention regarding exercising of option under Para 11(3) during service tenure in the proposal of EPFO nor in the approval accorded by MoL&E]

Vide Parveen Kohlis RTI application no. MLABE/R/E/20/00923 dated 6.6.2020, at Point no. 7, he sought following information to which MoL&E has replied that there is no other approval except dt. 16.3.2017

Point no. 7
The proposal of EPFO vide no. Pension-I/12/33/EPS Amendment/96 Vol.II/1839 dated 5/10.1.2017 regarding implementation of judgment in RC Gupta case was meant for Provident Fund & Pension Members including superannuated cases **(refer Para 6, 9 & 10)**and similarly the proposal of o/o MoL&E was also meant for Provident Fund & Pension Members including superannuated cases **(refer Para 7). **Accordingly, MoL&E had accorded approval to the said proposal which had been issued vide no. R-15011/01/2017-SS.II dated 16.3.2017. Has any other approval except dt. 16.3.2017 (as above) been issued by MoL&E and if yes, please provide me copies of the relevant documents (NP & CP) and its reasons as per Section 4(d) of the RTI Act

Reply by MoL&E dt. 22.7.2020: NO

Point no 6 of the RTI is regarding increase of MINIMUM PENSION
