As all EPS 95 Pensioners are aware, EPFO HQ had got Special Audit conducted in r/o the settled Pension Revision Cases on Higher salary in compliance of Judgment dt. 4.10.2016 of Hon’ble Supreme Court in RC Gupta Case and HQ circular dt. 23.3.2017 at the following three Regional Offices:
- Regional Office, EPFO, Thiruvananthapuram
- Regional Office, EPFO, Chandigarh
- Regional Office, EPFO, Puducherry
After receiving the Special Audit Reports, Parveen Kohali Sir had sought copies of the replies sent by all the above three EPFO Regional Offices to EPFO HQ. Parveen Kohali Sir have received their replies.
In these reports & the replies of EPFO Regional Offices, you won’t find anywhere that the options under Para 11(3) of EPS’95 is required to be submitted only prior to retirement/attaining the age of 58 years i.e. only during service tenure of the pensioner.
Further, all the three ROs have maintained their stand in revising the pensions on higher wages/salary as under:
In these reports & the replies of EPFO Regional Offices, you won’t find anywhere that the options under Para 11(3) of EPS’95 is required to be submitted only prior to retirement/attaining the age of 58 years i.e. only during service tenure of the pensioner.
Further, all the three ROs have maintained their stand in revising the pensions on higher wages/salary as under:
- Regional Office, EPFO, Thiruvananthapuram has taken its stand in support of non availability of approvals under Para 26(6) at this belated stage.
- Regional Office, EPFO Chandigarh has taken its stand that pensions had been revised in accordance with decision dt. 24.1.2018 taken by the Zonal Office in the absence of any clarifications from HQ
- Regional Office, Puducherry has taken its stand by referring to Para 16-A of the EPS’95 which says that “Guarantee of Pensionary benefits - None of the Pensionary benefits under the Scheme shall be denied to any member or beneficiary for want of compliance of the requirement by employer under sub-paragraph( 10 of paragraph 3 provided, however, that employer shall not be absolved of his liabilities under the Scheme”
