Dear EPS 95 Pensioners Friend, Today in this article i am going to share a very good order passed by the Central Information Commission on 15.4.2020 wherein upon considering the advanced age of the appellant as well his request for early hearing, the Commission has provided an opportunity of OUT OF TURN hearing to the Appellant.

Further, the stand of EPFO, Gurugram (Haryana)  to the effect that the case of pension revision of the Appellant has not been processed because the issue is pending adjudication in the Supreme Court and as such EPFO has stopped processing any such claims. The Commission opined that if there is no stay in the matter, stoppage of processing the claims of higher pension is unlawful. EPFO had, therefore, been directed that if there is no stay order from the Hon’ble Apex Court, they should resolve the grievance of pension revision.

इसके अलावा, EPFO, गुरुग्राम (हरियाणा) के इस रुख के प्रभाव में कि अपीलार्थी के पेंशन संशोधन के मामले पर कार्रवाई नहीं की गई है, क्योंकि यह मुद्दा उच्चतम न्यायालय में लंबित है और चूंकि EPFO ने इस तरह के दावों को संसाधित करना बंद कर दिया है। आयोग ने कहा कि यदि इस मामले में कोई रोक नहीं है, तो उच्च पेंशन के दावों को संसाधित करने का ठहराव गैरकानूनी है। इसलिए, EPFO ​​को निर्देशित किया गया था कि यदि माननीय सर्वोच्च न्यायालय का कोई स्थगन आदेश नहीं है, तो उन्हें पेंशन संशोधन की शिकायत का समाधान करना चाहिए।
