We, the office bearers of ITI Retired Officers Association and on behalf of our entire retired executives and staff, do hereby convey our most respectful regards to your Esteemed good self and wish to convey our grateful thanks for your kind letter Lt No DEL/TS/0325 dated 12-03-2020 to Honourable Minister of Labour & Employment on the issue of EPS 95 pension.
Kindly permit us to very briefly dwell about this issue of EPS 95 pension revision based on actual salary by EPFO
Ever since the verdict of Honorable High Court of Kerala as per order dated 31-03-2016 of the Apex Court in SLP (C) No 7074/2014, we have been requesting both Honorable Minister of Labour & Employment and Central PF Commissioner for extending the option for revision of EPS 95 pension based on actual salary to one and all without any discrimination.
The EPFO instructions of 23-03-2017, pursuant to the above request of ours and several organizations, was a great boon to all desirous optees, who were willing to make additional contributions to Pension funds with interest, for the revision of EPS 95 pensions.
However, on 31-05-2017, EPFO brought out another instruction barring its implementation for retirees of Exempted Companies, on the ground that their accounts are not available with them. This is not only a lame reason but also totally discriminatory amongst the EPS 95 pensioners. It is very much surprising to note that this rule is again discriminating even amongst the EPS 95 pensioners of Exempted establishments, as more than 23000 pensioners belonging to Exempted companies are already drawing revised pension based on their actual salary.
We have submitted several appeals against this discriminatory treatment amongst the EPS 95 pensioners to every highest level in EPFO, Labour Ministry, MPs and even to our Most Honorable Prime Minister, but of no avail. Just for your kind information, we wish to draw your attention to Para 2.0 of our enclosed letter dated 18-10-2018 to Honorable Prime Minister
In this backdrop, we are extremely pleased and highly delighted to note that your honorable goodself has taken up this issue and escalated at the level of Honorable Minister for Labour & Employment.
We are immensely thankful for your kind Samaritan effort of this and wish that it will swiftly bear fruit for all the 65 lakh EPS 95 pensioners of Exempted Establishments
