The batch matter (44 writ petitions) from employees of exempted establishments was listed today as first item before the bench of Hon Justices SK Kaul and KM Joseph.

EPFO and the Union of India were represented by Sh KK Venugopal, Ld Attorney General for India.
After hearing initial submissions the bench expressed its disagreement with the principal claim of the petitioners that they are entitled to improve their option at this stage to claim higher pension by remitting additional contribution. The bench observed that this is opposed to all settled principles of insurance and acturial science.
Despite vehement opposition the bench proceeded to direct tagging of the matters herein with the SLP of Union and EPFOs Review Petition challanging the Kerala High Court judgement before the concerned three judges bench.
All matters will now be listed before the concerned three judges bench as connected cases.
