EPS 95 Pension Latest Update From EPFO Under RTI, Must Read

Dear friends,
In Parveen Kohali Sirs, RTI application no. EPFOG/R/2019/68778 dt. 28.11.2019, He had sought following information:
Your kind attention is invited towards the letter dt. 19.11.2019 of the CPIO in reply to his application no. EPFOG/R/2019/66382/1 dt. 16.10.2019
Provide following information duly certified & point wise
EPS 95  Higher Pension List Issued By EPFO Search Your Name Below:

 1. His aforesaid application dt. 16.10.2019 was in English language but the CPIO has replied to him in Hindi language, which he cannot understand properly. He will be grateful if, as a special case, the same reply is provided to me in English language for its better understanding. He confident that you will ensure that there may not be any difference in the contents of both replies - one in Hindi & the other in English in r/o same application.

2. In the aforesaid reply dt. 19.11.2019, it had been stated by the CPIO that as per judgment of SC, the benefit is to be given to ONLY HPTDC EMPLOYEES. Please provide me a copy of that relevant page of the said judgment stating that i.e. the benefit is to be given to ONLY HPTDC EMPLOYEES.

3. In the aforesaid reply dt. 19.11.2019, it had been stated by the CPIO that in case no option is exercised under Para 26(6) & Para 11(3), one can apply for its ex-post-facto approval. Please provide me a copy of such instructions or circular or GSR or any order of a competent authority or judgment of any court of law or any document based on which, the CPIO had provided me that information.
Vide letter dt. 15.1.2020, the CPIO has informed as under:

“Point no. 1: Due to wrong understanding of judgment, the then CPIO has wrongly informed you about the implementation of judgment. We regret the inconvenience.
Point no. 2: There is no such instructions under EPS 95 for option under 11(3), however para 26(6) of EPF Scheme pertains to permission to contribute PF contribution over & above statutory limit. Hence, sometimes employees/employers start contributing PF contributing over wage ceiling before getting approval from EPFO. In such cases ex-post facto permission used to be given, as there was no extra financial burden to the Deptt.”
