GOOD NEWS FOR EPS95 PENSIONERS:Rajasthan High Court, Jaipur All EPS’95 Appeals Filed by EPFO Before the Division Bench DISMISSED on 28 August 2019

All EPS’95 Appeals filed by EPFO before the Division Bench of Rajasthan High Court, Jaipur against the order of Single Bench have been DISMISSED on28 August 2019. Concerned Advocate for the information of all pensioners especially from Rajasthan which is being reproduced below. Copy of the order is awaited.

On 28 August the Division Bench Special Appeals arising out of the Judgment dated 11.12.2018 were listed before the Division Bench Presided by Hon’ble Chief Justice Shri Ravindra S. Bhat and Justice Indrajeet Singh. These appeals were filed by EPFO against the judgement whereby Hon’ble Single Judge ordered to grant pension on actual salary. The division bench while deciding the appeals made applicable the directions given by Delhi High Court in Bhartiya Khadya Nigam Karamchari Sangh (BKNKS/FCI) case. Thus the petitioners would be entitled pension on actual salary and interest. However the decision will be subject to the outcome of final judgment of cases pending in the Hon’ble Supreme Court.

One more important thing is that the benefit of this Judgment will be available only for writ petitioners. In such circumstances remaining employees who want pension on actual salary will have to file writ petition.

माननीय मुख्य न्यायाधीश श्री रविन्द्र एस. भट और न्यायमूर्ति इन्द्रजीत सिंह की अध्यक्षता वाली खंडपीठ के समक्ष 28 अगस्त को डिवीजन बेंच विशेष अपील 11.12.2018 को हुई। ये अपील EPFO ​​द्वारा उस फैसले के खिलाफ दायर की गई थी जिसके तहत माननीय एकल न्यायाधीश ने वास्तविक वेतन पर पेंशन देने का आदेश दिया था। खंडपीठ ने भारतीय ख्याद निगम करमचारी संघ (BKNKS / FCI) मामले में दिल्ली उच्च न्यायालय द्वारा दिए गए निर्देशों को लागू करते हुए अपील पर फैसला किया। इस प्रकार याचिकाकर्ता वास्तविक वेतन और ब्याज पर पेंशन के हकदार होंगे। हालाँकि यह निर्णय माननीय सर्वोच्च न्यायालय में लंबित मामलों के अंतिम निर्णय के परिणाम के अधीन होगा।
